Copyright and ownership

All software, apps, Stream Deck profiles and plugins, tablet apps, .amm aircraft sets, liveries, code, graphics, icons, artwork, videos, text, documentation, sounds and other content made or sold by ClearedToCode Inc. ("ClearedToCode", "we", "us") are owned by ClearedToCode Inc. or its licensors and are protected by United States copyright law (Title 17 of the U.S. Code), international copyright treaties and other intellectual property laws.

Buying or downloading a product gives you a licence to use it. It does not sell or transfer ownership of the product, its code or any copyright to you.

Software licence (end user licence agreement)

By downloading, installing, activating or using any ClearedToCode product you agree to this licence. If you do not agree, do not install or use the product.

Grant. Subject to these terms and to paying any price that applies, ClearedToCode Inc. grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the product for your own personal, non-commercial flight simulation use, on computers you own or control.

Free products are licensed on the same terms. Being free does not make a product public domain or open source, and does not allow re-uploading or redistribution.

Licence keys. Where a product uses a licence key or serial, the key is for you alone. You may not share, publish, sell, give away or transfer a key, or let other people use it. Keys found shared or published may be cancelled without a refund.

Updates. Updates, patches and new versions we provide are covered by this licence unless they come with their own terms.

You may NOT, and may not help or allow anyone else to:

• copy, share, upload, re-host, mirror, torrent or otherwise distribute any product, in whole or in part, on any website, file host, Discord server, forum, marketplace or other channel;
• sell, resell, rent, lease, lend, sublicense, bundle or include a product in any paid or free package, pack, collection or service;
• reverse engineer, decompile, disassemble, decrypt or try to extract the source code, assets or data of a product, except to the extent the law expressly allows despite this restriction;
• remove, bypass, disable, crack or work around any licence key, demo timer, activation, update check or other protection, or make, share or use any key generator, crack, patch or modified build;
• modify, translate, adapt or build a derivative work from a product, and then share, publish or sell it (including edited Stream Deck profiles, re-skinned decks, repackaged tablets or converted aircraft sets);
• copy our button layouts, key artwork, icons, page designs, profiles, .amm data, documentation or store text to make a competing or look-alike product;
• remove or change any copyright notice, trademark, logo, licence file or credit in a product;
• use a product for commercial training, paid streaming services sold as a product, or any business purpose without our written permission (personal streaming and videos showing you using the product are welcome);
• use a product in breach of any law, or of the terms of Microsoft Flight Simulator, Elgato or any other platform the product runs with.

Ending the licence

This licence lasts until it ends. It ends automatically, without notice, if you break any of these terms. We may also cancel licence keys and accounts that are shared, resold, charged back or used in breach of these terms.

When the licence ends you must stop using the product and delete every copy you have. Sections on ownership, restrictions, enforcement, disclaimers, liability and governing law continue after the licence ends.

Piracy and enforcement

We actively look for copies of our products shared without permission, and we enforce our rights.

Unauthorised copying or distribution is copyright infringement under 17 U.S.C. § 501. Under 17 U.S.C. § 504, a copyright owner can recover actual damages and profits, or statutory damages of up to $150,000 per work for wilful infringement, plus legal costs and attorney's fees under 17 U.S.C. § 505. Removing, cracking or bypassing a licence key, demo timer or other protection, or sharing tools that do so, is separately unlawful under the Digital Millennium Copyright Act, 17 U.S.C. § 1201.

When we find infringement we may, without further notice: send takedown notices to websites, file hosts, Discord, search engines, payment providers and internet service providers; cancel licence keys, accounts and downloads; ban the people involved from our store, Discord and community; and bring legal action for damages, an injunction and costs.

Report a pirated or copied product

Seen a ClearedToCode product shared, sold or re-uploaded somewhere it should not be, or a product that copies ours? Please tell us at jesse@clearedtocode.com with the link and any screenshots. Reports are kept private.

Copyright complaints (DMCA notices)

We respect the intellectual property of others. If you believe content on clearedtocode.com (including a community upload, discussion post or profile) infringes your copyright, send a notice to our copyright agent: ClearedToCode Inc., Attn: Copyright Agent, Fort Walton Beach, Florida, United States, jesse@clearedtocode.com.

Your notice must include, as 17 U.S.C. § 512(c)(3) requires:

• your physical or electronic signature;
• the copyrighted work you say is infringed;
• the material you say is infringing and where it is on our site (a link is best);
• your name, address, telephone number and email address;
• a statement that you believe in good faith the use is not authorised by the copyright owner, its agent or the law;
• a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act for the owner.

If your content was removed and you believe that was a mistake, you may send a counter-notice under 17 U.S.C. § 512(g) with the same contact details. We remove the accounts of repeat infringers.

Trademarks

ClearedToCode, the ClearedToCode logo and mark, and our product names and logos are trademarks of ClearedToCode Inc.. You may not use them in a way that suggests you are us, that we made or approved your product, or in any domain name, store listing, social account or product name without our written permission.

Microsoft Flight Simulator is a trademark of Microsoft Corporation. Stream Deck is a trademark of Elgato / Corsair. Aircraft, developer, airline and hardware names (for example PMDG, Fenix, iniBuilds, Black Square, BlueBird, FlightFX, GSX and WinWing) are trademarks of their owners and are used only to say which product ours works with. ClearedToCode is an independent company and is not affiliated with, sponsored by or endorsed by any of them unless we say so.

Use of this website

By using clearedtocode.com you agree to these terms. You must give accurate information when you create an account or buy, keep your password private, and are responsible for what happens on your account.

You may not scrape, copy or mirror the site or its product pages, images or text; try to get into accounts, admin pages, downloads or files you have not paid for or been given; interfere with the site, its security or its payments; or post anything unlawful, abusive, misleading or that infringes someone else's rights.

Content you post (discussions, comments, reviews, uploads, bug reports, feature requests) stays yours, but you give us a worldwide, royalty-free licence to host, show, copy and use it to run and promote the site and our products. You confirm you have the right to post it. Ideas and suggestions you send us may be used freely with no payment owed.

Purchases and digital delivery

Prices are shown in U.S. dollars. Products are digital and are delivered by download and, where used, a licence key sent to the email given at checkout.

Because digital products cannot be returned, sales are final once a licence key has been delivered or a file has been downloaded, except where the law requires otherwise. If something does not work, contact us first and we will do our best to put it right.

Opening a chargeback or payment dispute for a product you received cancels its licence key and downloads while the dispute is open.

Disclaimer

Products are for flight simulation and entertainment only. They are not for real-world flight, navigation, maintenance, training or operational use. Real-world documents, procedures and data referenced in our products may be simplified or out of date.

PRODUCTS AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, CLEAREDTOCODE INC. DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT A PRODUCT WILL WORK WITH EVERY SIMULATOR VERSION, AIRCRAFT UPDATE, HARDWARE OR SYSTEM, OR THAT IT WILL BE ERROR-FREE.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, CLEAREDTOCODE INC., ITS OWNERS, EMPLOYEES AND CONTRACTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS OR DAMAGE TO HARDWARE OR SOFTWARE, ARISING FROM YOUR USE OF A PRODUCT OR THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US FOR THE PRODUCT THE CLAIM IS ABOUT IN THE 12 MONTHS BEFORE THE CLAIM.

You agree to defend and hold ClearedToCode Inc. harmless from claims, losses and costs (including reasonable attorney's fees) that come from your breach of these terms or your misuse of a product.

Governing law

These terms are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute will be heard only in the state or federal courts located in Florida, and you agree to their jurisdiction. We may still seek an injunction in any court to stop infringement of our intellectual property.

If any part of these terms cannot be enforced, the rest stays in effect. Our not enforcing a term right away does not waive it. You may not transfer your rights under these terms; we may transfer ours.

Changes and contact

We may update this page. The date at the top shows when it last changed, and using our products or site after a change means you accept the updated terms.
